Court orders IRS Airlines to pay Yobe Attorney General N2m

A Federal High Court in Abuja has ordered IRS Airlines on the payment of damages worth N2 million for a breach in contract of carriage of the Attorney General of Yobe State, Ahmed Mustapha.

Ahmed Mustapha who was left stranded at the Abuja Airport as a result of the missed flight has claimed it led to his missing of several business and personal appointments. Delivering judgment, Justice Donatus Okorowo, held that it is a general principle of law that where there is a binding contract, there is liability in the event of breach.

The court has ordered a refund of his air ticket which is N18,000 and N2m as general damages for breach with an interest of the sum at the rate of 10 percent per annum, until the judgment sum is paid. A further N200,000 is to be paid as cost incurred in the prosecution of the case.

The Attorney General, who was travelling to Yola for meeting, purchased his air ticket at the Sheraton Hotel, Abuja the previous day.
